Terms of Service

These terms govern your use of NewsDiary (iOS app, Android app, Chrome extension, web app, and *.newsdiary.app API). By creating an account or using the service, you accept these terms.

1. Who can use NewsDiary

You must be at least 16 years old. You must give us a working email address and you may not impersonate another person.

2. Your content

You retain ownership of everything you save: articles you ingest, annotations, voice recordings, diary entries.

You grant Cape Wesley a limited licence to store, process, and display your content solely to operate NewsDiary for you — for example, running the LLM tools you trigger and syncing your data across your own devices.

We do not claim any rights beyond that. In particular:

• We do not train machine-learning models on your content.
• We do not sell or rent your content.
• We do not surface your private annotations or diary entries to other users. Visibility defaults to private; changing it to group or public is an explicit per-item action.

3. Acceptable use

You may not:

• Scrape NewsDiary content for resale or to populate a third-party product.
• Use NewsDiary to bulk-mirror copyrighted news content beyond what you personally read.
• Create accounts automatically, by bot, or in bulk.
• Reverse-engineer the LLM prompts, security tokens, or anti-abuse rules.
• Attempt to defeat tier quotas (rate limits, audio minutes, budget caps) by creating multiple accounts.
• Upload content that infringes someone else's rights.
• Post, share or send content that is objectionable: hate speech, that is attacks on people for their race, ethnicity, nationality, religion, caste, sex, gender identity, sexual orientation, disability or illness; harassment and bullying, including repeated unwanted contact, insults and doxxing; sexual content, including nudity and anything involving minors; violence and threats, including graphic violence and incitement to it; promotion of self-harm, suicide or eating disorders; illegal content; spam and scams, including phishing and malware; and impersonation of another person or organisation.
• Use the service for spam, phishing, or to distribute malware.

Any member can report a comment, annotation, article, profile or chat message in the app, with a reason and an optional note. A person reads each report. Where a rule is broken we remove the content, mute the member, remove the member from a Lounge or suspend the account, depending on severity, with or without notice. Owners and moderators of a Lounge can also remove content and mute members in their own Lounge. You can block any member at any time. Hard violations (CSAM, credible threats) are reported to the relevant authorities.

4. Public content (when enabled)

Sprint 7 introduces public profiles. When you make a profile or an annotation public, you accept that the content can be read, quoted, and linked to by other NewsDiary users. You can revoke visibility at any time, but copies in transit (e.g. cached views) may persist briefly.

5. AI features and grounding

NewsDiary uses Claude (Anthropic) and Apple Foundation Models to power summaries, bias detection, fact-checking, contextual notes, and the glossary. Fact-check and context features ground their output via Brave Search.

Generated text is assistance, not authority. You should not rely on LLM output for medical, legal, financial, or safety-critical decisions without independent verification. We do our best to keep the prompts honest about uncertainty but cannot guarantee accuracy.

If a generated output is harmful or wrong, please report it to services@capewesley.com so we can refine the prompts.

6. Paid tiers

NewsDiary launches with a free tier and a Founders tier (free for the first cohort). Paid plans (Plus, Pro) are introduced later (Sprint 9+). Until paid plans go live, all features available to your tier are free.

Billing and refund terms for paid plans will be appended here when they ship.

7. Tier quotas

Free, Plus, Pro, and Founder tiers have different limits (monthly audio minutes, LLM budget per month). A PDF you import can be up to 20 MB, on every tier; the AI layers read PDFs of up to 50 pages. Limits are listed in-app and may be adjusted with reasonable notice if our infrastructure costs change.

8. Termination

You may close your account at any time via POST /me/delete in-app. We may close accounts that:

• Violate Section 3 (Acceptable use).
• Have been inactive for more than 24 consecutive months and carry no paid subscription.

On termination, your data follows the retention rules in the Privacy Policy, Section 4.

9. Disclaimers

NewsDiary is provided "as is". To the extent permitted by law, Cape Wesley disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do our best to keep the service running, but we do not guarantee uninterrupted availability. The MVP runs on a single backend replica, which means scheduled and unscheduled downtime can occur.

10. Limitation of liability

To the extent permitted by law, Cape Wesley's total aggregate liability for any claim related to NewsDiary is limited to the amount you paid us in the 12 months preceding the claim, or EUR 100 — whichever is greater.

This limit does not apply to liability that cannot be excluded by law (e.g. gross negligence, wilful misconduct, statutory consumer rights).

11. Governing law

These terms are governed by French law. Disputes arising under these terms fall under the jurisdiction of the courts of Paris, without prejudice to mandatory consumer protections in your country of residence.

12. Changes

We may revise these terms. The current policy_version is shown above and recorded with every consent. If we bump the version, you will see a re-consent screen on your next session.
