Terms of Service

These terms govern your use of NewsDiary (iOS app, Chrome extension, and *.newsdiary.app API). By creating an account or using the service, you accept these terms.

1. Who can use NewsDiary

You must be at least 16 years old. You must give us a working email address and you may not impersonate another person.

2. Your content

You retain ownership of everything you save: articles you ingest, annotations, voice recordings, diary entries.

You grant Cape Wesley a limited licence to store, process, and display your content solely to operate NewsDiary for you — for example, running the LLM tools you trigger and syncing your data across your own devices.

We do not claim any rights beyond that. In particular:

We may suspend or terminate accounts that violate these rules, with or without notice depending on severity. Hard violations (CSAM, credible threats) are reported to the relevant authorities.

4. Public content (when enabled)

Sprint 7 introduces public profiles. When you make a profile or an annotation public, you accept that the content can be read, quoted, and linked to by other NewsDiary users. You can revoke visibility at any time, but copies in transit (e.g. cached views) may persist briefly.

5. AI features and grounding

NewsDiary uses Claude (Anthropic) and Apple Foundation Models to power summaries, bias detection, fact-checking, contextual notes, and the glossary. Fact-check and context features ground their output via Brave Search.

Generated text is assistance, not authority. You should not rely on LLM output for medical, legal, financial, or safety-critical decisions without independent verification. We do our best to keep the prompts honest about uncertainty but cannot guarantee accuracy.

If a generated output is harmful or wrong, please report it to services@capewesley.com so we can refine the prompts.

6. Paid tiers

NewsDiary launches with a free tier and a Founders tier (free for the first cohort). Paid plans (Plus, Pro) are introduced later (Sprint 9+). Until paid plans go live, all features available to your tier are free.

Billing and refund terms for paid plans will be appended here when they ship.

7. Tier quotas

Free, Plus, Pro, and Founder tiers have different limits (monthly audio minutes, PDF size cap, LLM budget per month). Limits are listed in-app and may be adjusted with reasonable notice if our infrastructure costs change.

You may close your account at any time via POST /me/delete in-app. We may close accounts that:

9. Disclaimers

NewsDiary is provided "as is". To the extent permitted by law, Cape Wesley disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do our best to keep the service running, but we do not guarantee uninterrupted availability. The MVP runs on a single backend replica, which means scheduled and unscheduled downtime can occur.

10. Limitation of liability

To the extent permitted by law, Cape Wesley's total aggregate liability for any claim related to NewsDiary is limited to the amount you paid us in the 12 months preceding the claim, or EUR 100 — whichever is greater.

This limit does not apply to liability that cannot be excluded by law (e.g. gross negligence, wilful misconduct, statutory consumer rights).

11. Governing law

These terms are governed by French law. Disputes arising under these terms fall under the jurisdiction of the courts of Paris, without prejudice to mandatory consumer protections in your country of residence.

12. Changes

We may revise these terms. The current policy_version is shown above and recorded with every consent. If we bump the version, you will see a re-consent screen on your next session.
